The EB-2 National Interest Waiver is a US green card, permanent residence not a temporary visa, that you can petition for yourself with no job offer or labour certification. It is not an investment programme: you qualify through an advanced degree or exceptional ability and a US endeavour of national importance.

Answer and evidence
The EB-2 National Interest Waiver is a US green card for holders of an advanced degree or exceptional ability whose proposed work has substantial merit and national importance; under the three-part Dhanasar test the job offer and labour certification can be waived, so applicants may self-petition.
Overview
The EB-2 National Interest Waiver (NIW) is a US green card you can self-petition, with no job offer and no PERM labour certification. You need an advanced degree or exceptional ability and must meet the three-part Dhanasar test: a nationally important endeavour you are well positioned to advance. No investment is required.
The EB-2 NIW is a qualification-based green card, not an investment programme: no payment can qualify you. It grants permanent residence, and the United States has no citizenship by investment.
The EB-2 National Interest Waiver (NIW) is a US immigrant petition in which USCIS waives the job offer, and with it the labour certification, because your proposed endeavour is in the US national interest. Its legal basis is INA section 203(b)(2)(B)(i), the regulation at 8 CFR 204.5(k), the precedent decision Matter of Dhanasar, 26 I&N Dec. 884 (AAO 2016), and Volume 6, Part F, Chapter 5 of the USCIS Policy Manual.
A US employer may also file the petition with a waiver request; the test is the same. This page concentrates on the self-petition.
You must first qualify for the EB-2 category itself, in one of two ways set out on the USCIS EB-2 page.
The six types of evidence are: an academic record relating to the area of exceptional ability; letters documenting at least 10 years of full-time experience; a licence or certification for the profession; a salary or remuneration that demonstrates exceptional ability; membership in professional associations; and recognition for achievements and significant contributions from peers, government entities, or professional or business organisations. Where these standards do not readily apply to your occupation, comparable evidence may be submitted (8 CFR 204.5(k)(3)(iii)). Whether a foreign degree is the equivalent of the US degree is assessed case by case.
The Dhanasar test is the three-part standard USCIS applies to every NIW request. Under USCIS Policy Manual Volume 6, Part F, Chapter 5, USCIS may grant the waiver, as a matter of discretion, if you show all three prongs by a preponderance of the evidence:
The test is about the endeavour: the petition defines precisely what you will do in the United States, why it matters nationally and why you can carry it forward. A labour shortage in your occupation does not by itself meet the third prong.
For every profile, a degree in itself does not show you are well positioned. To test your evidence, book a free consultation.
The NIW has no investment requirement. The table shows the US government fees as of 12 October 2026, read from USCIS Form G-1055 (edition 10/07/26) and 22 CFR 22.1.
| Fee | Amount (USD) | Notes |
|---|---|---|
| Form I-140, paper filing | US$715 | Immigrant petition, filed by you as self-petitioner |
| Form I-140, online filing | US$665 | Online filing where available |
| Asylum Program Fee, self-petitioner | US$300 | Paid with the I-140; an employer pays US$600, a small employer US$300, a nonprofit US$0 |
| Premium processing (Form I-907, optional) | US$2,965 | USCIS acts on the I-140 within 45 business days |
| Immigrant visa application fee, consular route | US$345 | Employment-based immigrant visa, per 22 CFR 22.1 |
Two further fees depend on your route and are confirmed before filing: the Form I-485 fee if you adjust status inside the United States, and the USCIS Immigrant Fee after a consular immigrant visa is issued. These are government fees only. Mirabello's advisory fee and the independent US attorney's fee are separate. Fees change: verify against the official source before you file.
There is no single official timeline. With premium processing, USCIS acts on the I-140 within 45 business days; the clock stops if USCIS requests evidence or issues a notice of intent to deny. It does not make a visa number available sooner. We check current times for your case rather than quote one figure.
Immigrant visa numbers are limited by category and by per-country caps, and the State Department's monthly Visa Bulletin publishes cut-off dates for each category and country of chargeability. When your priority date is earlier than the cut-off, a green card can be issued; when demand exceeds supply, you wait. EB-2 has historically been more backlogged than EB-1 for high-demand countries. For October 2026, USCIS directs employment-based adjustment filers to the Dates for Filing chart. Cut-off dates change monthly, so we read the current bulletin for your country rather than publish a date here.
Your spouse and unmarried children under 21 may apply for derivative immigrant status once the I-140 is approved, and as permanent residents they may work without restriction. While an I-485 is pending, a derivative spouse may apply for an employment authorisation document. The Child Status Protection Act may protect children close to 21, case by case.
Yes, through naturalisation. After at least 5 years as a lawful permanent resident, you may apply on Form N-400 under the conditions on the USCIS naturalisation page: continuous residence for those 5 years, physical presence of at least 30 months, 3 months in your state or USCIS district, good moral character, basic English and civics, and the Oath of Allegiance. You must be at least 18. The N-400 fee is US$760 on paper or US$710 online as of 12 October 2026. Long absences from the United States can put permanent-resident status at risk.
The NIW is open to all nationalities, including Europeans without an E-2 treaty: Greece is an E-1 country only, and Hungary, Cyprus, Malta, Iceland and Liechtenstein are not on the State Department treaty table. For German, Austrian, Swiss, Italian, French, Dutch, Spanish, Portuguese and Turkish nationals, the NIW is the permanent alternative to a renewable E-2.

| Route | Based on | Status | Who files |
|---|---|---|---|
| EB-2 NIW | Advanced degree or exceptional ability plus the Dhanasar test | Green card (permanent residence) | You, or an employer |
| EB-1A | Top-of-field acclaim: a one-time achievement or 3 of 10 criteria | Green card (permanent residence) | You, or an employer |
| O-1A | Extraordinary ability; no investment | Temporary, renewable | A US employer, agent or your US company |
| EB-5 | Capital at risk and job creation | Green card (permanent residence) | You, as investor |
EB-1A premium processing is 15 business days against 45 for the NIW, and EB-1 and EB-2 have separate visa queues. The E-2 treaty investor visa is temporary and limited to treaty nationals. For every route side by side, start at our USA immigration hub.

Summary: Naturalisation via Form N-400 after at least 5 years as a lawful permanent resident, with continuous residence for those 5 years, physical presence of at least 30 months, 3 months in the state or USCIS district, good moral character, basic English and civics, and the Oath of Allegiance. Two layers. First, you must qualify for EB-2: an advanced degree, meaning a US master's or higher or a foreign equivalent, or a bachelor's plus at least 5 years of progressive experience; or exceptional ability, shown by at least 3 of 6 types of evidence. Second, you must meet all three prongs of the Dhanasar test for the waiver.
Yes. The national interest waiver removes the job offer and the PERM labour certification, so you may file Form I-140 for yourself. The petition must still include Form ETA-9089 Appendix A and a signed ETA-9089 Final Determination, without Department of Labor certification.
Some can. USCIS says not every entrepreneur qualifies: broad claims of job creation are not enough, and owning a company rarely establishes eligibility on its own. Third-party investment, accelerator participation, grants, intellectual property, revenue or job growth, media coverage and independent letters all help show you are well positioned.
No. The NIW is based on qualifications and the national interest of your endeavour, not on capital, and no payment can qualify you. If you want a green card based on investment, see the EB-5 programme.
There is no single official timeline. With premium processing (US$2,965), USCIS acts on the I-140 within 45 business days. The total time to a green card then depends on visa availability for your country of chargeability and on I-485 or consular processing times.
It speeds only the I-140 decision, to 45 business days, and the clock stops if USCIS requests more evidence. It does not make a visa number available sooner, so its value depends on whether your priority date is already current. Premium processing can be added to a pending NIW petition.
The standards differ rather than rank. The EB-1A requires sustained acclaim at the very top of your field; the NIW requires an advanced degree or exceptional ability plus a nationally important endeavour you are well positioned to advance. Some applicants qualify for both and weigh the separate EB-1 and EB-2 visa queues. See the EB-1A green card.
For a petition that needs no labour certification, such as the NIW, the priority date is the date the complete, signed I-140 with all initial evidence and the correct fee is properly filed with USCIS (8 CFR 204.5(d)). It sets your place in the Visa Bulletin queue.
Yes. The EB-2 national interest waiver is an active classification, verified on uscis.gov in October 2026. What varies is visa-number availability, which the Visa Bulletin publishes each month for each country of chargeability.
Yes, an NIW petition is filed separately from your current status. For the O-1 specifically, 8 CFR 214.2(o)(13) says filing a preference petition is not a basis for denying an O-1 petition, extension, admission or change of status. If you are lawfully in the United States, you may later adjust status there. See the O-1 visa.
While an I-485 is pending, a derivative spouse may apply for an employment authorisation document. Once the spouse is a permanent resident, work rights are unrestricted. Unmarried children under 21 are also included.
Yes. From the first day of lawful permanent residence in a calendar year you are a US tax resident under the IRS green card test, and your worldwide income is subject to US tax. State tax, FBAR and FATCA reporting may also apply. This is general information, not tax advice; confirm your position with a qualified tax adviser.

Estate planning
A US visa or green card does not change your nationality and adds no law you can elect under EU Regulation 650/2012 (Article 22). If you come to live in the United States, Article 21 may point to the law of the US state where you habitually live, unless you elect the law of a nationality you already hold. US immigration status changes no tax position by itself: US tax residence follows its own tests.
The law of United States reserves no fixed share for family members, so an estate can generally be left as you choose, although dependants may still have claims.
See the United States position in our succession matrix, or read which law governs your estate. General information, not legal advice.
