Overview

What is the Gibraltar Category 2 Residence programme?

The Category 2 Individual certificate, Gibraltar's retirement route for people of substantial means, is a tax-status residence with no fixed term for people with net assets of at least £2,000,000 and approved accommodation in Gibraltar. It is a net-worth test, not an investment, and a minimum tax of £37,000 a year applies whatever your income.

  • Tax-status residence; no fixed investment
  • Income tax capped (~£37k-£42k/yr)

Category 2 is residence by financial means. Nothing is invested or donated: you show substantial net assets, keep approved accommodation in Gibraltar and pay income tax within a fixed band, and your assets stay yours. It is a tax status for high-net-worth individuals rather than an income-based retirement visa, with no income or pension test.

What is Gibraltar Category 2 residence?

Category 2 is a certificate of tax status issued under the Qualifying (Category 2) Individuals Rules 2004 (L.N. 2004/070), made under sections 37, 37A, 41A and 98 of the Income Tax Act 2010 and consolidated to L.N. 2026/127 (read 11 October 2026). The Finance Centre Director of Gibraltar Finance issues the certificate and the Income Tax Office (read 11 October 2026) administers the tax. It has no fixed term (r. 6) and is endorsed every three years.

Category 2 is sometimes listed among residence-by-investment programmes; it is the same certificate, and the Rules require no investment. In press release 469/2026 of 18 June 2026 (read 11 October 2026), the Government announced that a person who does not maintain Category 2 status will have no right to continue to reside in Gibraltar; that is not yet in the Rules. Category 2 gives residence, not nationality: see residency versus citizenship.

Who qualifies, and how much wealth do you need?

  • Net assets of at least £2,000,000. This is the Finance Centre's administrative criterion; the Rules themselves ask only for "substantial and sound financial standing" (r. 6(a)). It is a net-worth test, not an income test and not a deposit.
  • A higher bar is announced, not enacted: on 18 June 2026 the Government announced £5,000,000 for new applicants, with existing holders grandfathered. No commencement date or implementing text has been found, so it is not law.
  • Approved residential accommodation in Gibraltar, bought or rented, available for your exclusive use for the whole year of assessment, with no letting or leasing (rr. 2 and 3).
  • Good character, and nothing harmful to Gibraltar's reputation (r. 6).
  • No recent presence or work in Gibraltar. Rule 4 excludes anyone who, in the last five years of assessment, was present in Gibraltar for more than 183 days in any year, or an average of more than 90 days over any three of those years, or who carried on a trade, business, profession, vocation or employment there. The Finance Centre Director may waive this where a certificate benefits Gibraltar's economic development (r. 4(3)).
  • No income or pension test, and no requirement to remit or spend income in Gibraltar.

Category 2 does not fit a retiree with a pension but without substantial assets, or anyone who expects public healthcare or schooling, which the status does not provide. Nor does it fit anyone who wants to work in Gibraltar: a holder may not, unless the Finance Centre Director is satisfied it benefits Gibraltar's economic development (r. 5(1)), although duties incidental to a business abroad are not caught (r. 5(3)).

Is Gibraltar's retirement visa a golden retirement visa?

Not fully: it is rated Partial, 57.1 out of 100, with confidence grade B, in the Mirabello Golden Retirement Index, scored on 11 October 2026 under methodology 1.1. Partial means the route meets most of the standard, with one gap. The Index records no specific reason against Category 2: it is Partial because its score falls below the Golden line of 70. Its two weakest pillars are the path to permanent residence and citizenship, as no permanent step or official nationality route was established, and processing, as no official time is published. Its strongest is physical presence, with full marks: there is no minimum stay. Its renewal category is "unknown". Read the score with the costs below in mind: the status carries a minimum tax of £37,000 a year. The standard is Mirabello's own: Golden means at least 70 out of 100, confidence grade A or B and no fail on tax of foreign income, physical presence or renewal, and every route is scored from official sources.

Do you have to live in Gibraltar?

No minimum stay applies to Category 2: Gibraltar Finance (read 11 October 2026) states that there is no specific legal requirement as regards length of stay in any year. The Rules require a home instead: your approved accommodation must be available for your exclusive use for the whole year (r. 3), whether or not you are there.

The Rule 4 day counts are a look-back on applicants only, not a stay rule for holders. The certificate does not shield you from becoming tax-resident in another country, so time spent elsewhere still matters. The conditions of the residence card issued by the Civil Status and Registration Office to Category 2 holders were not found in the sources we read. To compare routes with light presence rules, see residency without relocating.

Does Gibraltar tax a foreign pension?

Not as income, but the status carries a fixed levy. For a Category 2 Individual, foreign pensions and dividends are excluded from assessable income unless you elect otherwise (r. 10(1) and (2)), yet a compulsory minimum tax of £37,000 a year is payable whatever your income. We classify the treatment as partial.

Tax is computed on the Allowances Based System only, on the first £118,000 of taxable income: 14% on the first £4,000, 17% on the next £12,000 and 39% on the balance. That gives a maximum of £42,380 a year, the figure published by the Income Tax Office. In the first and last years, the minimum is £3,083.33 per month or part month (r. 9(4) and (5)). The amounts change with the annual budget.

Foreign capital gainsGibraltar levies no capital gains tax (Income Tax Office, read 11 October 2026).

Legal basisQualifying (Category 2) Individuals Rules 2004, rr. 9 and 10; Income Tax Act 2010.

Tax follows tax residence, not the permit: the treatment applies once you are tax-resident in Gibraltar. The country that pays your pension may still tax it under its own rules or the relevant double tax treaty. This is general information, not tax advice. See also our guide to countries that don't tax foreign pensions.

How long does it take, what does it cost, and what documents do you need?

No official processing time is published, so we confirm the timeline for your case. The costs:

  • Application fee: £5,000, non-refundable (r. 8(1)(a), as amended by L.N. 2026/127 in June 2026).
  • Refundable advance of tax: equal to the maximum tax, £42,380 per the Income Tax Office, with the application (r. 8(1)(b)), and an advance of the same amount by 30 November in the year of assessment (r. 8(2)). It is refundable on rejection or relinquishment, net of outstanding tax (r. 8(3) and (4)). Whether the 30 November payment is a standing deposit or an annual prepayment is not yet officially confirmed.
  • Accommodation and advice: buying or renting approved accommodation (no figure is set), plus professional fees.
  • Private medical insurance: Civil Status and Registration Office guidance (read 11 October 2026) requires private comprehensive medical insurance with benefits of at least £100,000 a year; Gibraltar Health Service access does not qualify, and Category 2 confers no entitlement to publicly funded schooling or healthcare.

The documents: two character references (one from a bank, one from a law or accountancy firm), a passport copy, a CV and proof of financial standing.

Can your spouse and children be included?

Yes. Your spouse or civil partner and your children may elect to have their income treated as yours under your certificate, or apply for a certificate in their own right (r. 11). Whether any additional fee applies per dependant is not yet officially confirmed.

Renewal, permanent residence and citizenship

The certificate has no fixed term (r. 6). You present it for endorsement within the 30 days before each third anniversary of issue or last endorsement (r. 7(3)), and the Finance Centre Director must remain satisfied on your accommodation, good character, financial standing and payment of tax (r. 7(1)). It is revoked if tax is unpaid (r. 7(4)). The validity of the residence card issued to Category 2 holders was not established from the sources we read.

No permanent residence route for Category 2 holders was established from the official sources we read. Gibraltar is a British Overseas Territory; whether, and after how long, Category 2 residence counts towards British Overseas Territories citizenship is not yet officially confirmed. Plan it as long-term tax-status residence.

What the market gets wrong

  • "Category 2 needs a fixed investment." The Rules contain none; the cost is the minimum tax, the refundable advance and the accommodation, which may be rented.
  • "The application fee is £1,233" or "£1,100". The consolidated Rules now set £5,000 (r. 8(1)(a), as amended by L.N. 2026/127). The Gibraltar Finance tax-residence page still shows an older fee of £1,100 and a maximum tax near £44,740, and is out of date.
  • "New applicants already need £5,000,000." The rise was announced on 18 June 2026; no implementing text or commencement date has been found, so it is not yet law.
  • "A decision comes within one to two weeks." No official processing time is published; such figures are adviser estimates, not official ones.

Category 2 or another retirement route?

Category 2 suits a person of substantial means who wants a Gibraltar base with no minimum stay, no income test and a known band of annual tax, and who can carry the fixed costs. Its trade-offs are the net-worth bar, the restriction on local work, private healthcare only and no established path to permanent residence.

  • The Cyprus Category F permit is a permanent residence permit for third-country nationals who live on a foreign income; it is rated Golden in the Index.
  • The Monaco residence permit for persons of independent means is another European route where means are judged on the file, not against a published figure; it is also rated Partial.
  • The Turks and Caicos residence permit for persons of independent means sets no fixed amount either, but expects you to ordinarily reside in the Islands; it is rated Partial.

What is not yet officially confirmed

  • Whether, and from when, the announced £5,000,000 net-worth minimum for new applicants will take effect.
  • Whether the advance of tax due by 30 November is a standing deposit or an annual prepayment credited against that year's tax.
  • The year of assessment to which the published minimum and maximum tax apply; both change with the annual budget.
  • Processing time, and whether Gibraltar levies any wealth tax.
  • The validity, renewal and conditions of the residence card for Category 2 holders, and any permanent residence or British nationality route.
  • The specification or minimum value of approved accommodation, and any fee per dependant.

What is Gibraltar Category 2 residency?

Gibraltar Category 2 is a certificate of tax status for high-net-worth individuals under the Qualifying (Category 2) Individuals Rules 2004. You qualify with net assets of at least £2,000,000, the Finance Centre's administrative criterion, approved accommodation in Gibraltar and good character. There is no income test and no investment. The certificate has no fixed term and is endorsed every three years.

How much net worth do you need for Gibraltar Category 2?

The Finance Centre applies a criterion of net assets of at least £2,000,000; the Rules themselves ask for substantial and sound financial standing (r. 6(a)). On 18 June 2026 the Government announced a rise to £5,000,000 for new applicants, with existing holders grandfathered. No commencement date or implementing text has been found, so the higher figure is announced, not law.

Is Gibraltar's retirement visa a golden retirement visa?

Not fully. Category 2 is rated Partial, 57.1 out of 100 (grade B) in the Mirabello Golden Retirement Index, scored on 11 October 2026 under methodology 1.1. It falls below the Golden line of 70: no permanent residence step was established and no official processing time is published, although there is no minimum stay. It is a residence status, not citizenship, and needs no investment.

How much tax does a Category 2 individual pay?

Tax is computed only on the first £118,000 of taxable income, at 14%, 17% and 39%, which gives a maximum of £42,380 a year according to the Income Tax Office. A minimum of £37,000 a year is payable whatever your income. The amounts change with the annual budget, so we confirm the figures for your year. This is general information, not tax advice.

Does Gibraltar tax foreign pensions for Category 2 holders?

Not as income: foreign pensions and dividends are excluded from a Category 2 Individual's assessable income unless you elect otherwise (r. 10(1) and (2)). The compulsory minimum tax of £37,000 a year still applies. Tax follows tax residence, not the permit, and the country that pays your pension may still tax it under its own rules or a treaty. This is general information, not tax advice.

Do you have to live in Gibraltar to keep Category 2 status?

No minimum stay applies: Gibraltar Finance states there is no specific legal requirement as regards length of stay in any year. Your approved accommodation must, however, be available for your exclusive use for the whole year (r. 3). The certificate does not shield you from becoming tax-resident in another country, so time spent elsewhere still matters.

Do you have to buy property in Gibraltar for Category 2?

No. The approved residential accommodation may be bought or rented, but it must be available for your exclusive use for the whole year of assessment and may not be let or leased (rr. 2 and 3). No fixed value or size is published in the sources we read, so we confirm what the Finance Centre will approve for your case.

What does a Category 2 application cost, and how long does it take?

The non-refundable application fee is £5,000 (r. 8(1)(a)). A refundable advance of tax equal to the maximum tax, £42,380 according to the Income Tax Office, must accompany the application (r. 8(1)(b)). Accommodation, private medical insurance and professional fees come on top. No official processing time is published, so we confirm the timeline for your case.

Can my spouse and children be included in Category 2?

Yes. Your spouse or civil partner and your children may elect to have their income treated as yours under your certificate, or apply for a certificate in their own right (r. 11). Whether any additional fee applies per dependant is not yet officially confirmed. Ask Mira, by Mirabello for a first view, or book a free consultation.

Does Category 2 lead to permanent residence or British citizenship?

No permanent residence route for Category 2 holders was established from the official sources we read. The certificate has no fixed term and is endorsed within the 30 days before each third anniversary (r. 7(3)). Whether Category 2 residence counts towards British Overseas Territories citizenship, and after how long, is not yet officially confirmed; we check it against current law for your case.

Estate planning

How does Gibraltar succession law affect your estate?

A residence permit in Gibraltar does not change your nationality and adds no law you can elect under EU Regulation 650/2012 (Article 22). If you come to live in Gibraltar, the law of Gibraltar may govern your estate by default under Article 21, unless you elect the law of a nationality you already hold. The permit changes no tax position.

The law of Gibraltar reserves no fixed share for family members, so an estate can generally be left as you choose, although dependants may still have claims.

See the Gibraltar position in our succession matrix, or read which law governs your estate. General information, not legal advice.
