E-2 Visa to Green Card in 2026: Every Route from E-2 to Permanent Residence

The short answer

No. The E-2 treaty investor visa is a temporary, non-immigrant visa without dual intent, so it never turns into a green card by itself. An E-2 investor needs a separate immigrant route: EB-5 investment, the EB-1A or EB-2 NIW self-petitions, EB-1C through a multinational company, marriage to a US citizen, or employer sponsorship.

Key takeaways
  • The E-2 never converts. It is a temporary, non-immigrant visa without dual intent; a green card always needs a separate immigrant petition.
  • Six bridges exist. EB-5 investment, EB-1A extraordinary ability, EB-2 National Interest Waiver, EB-1C through a multinational company, marriage to a US citizen, and employer sponsorship.
  • EB-5 is the only investment green card. USD 800,000 in a targeted employment area or infrastructure project, or USD 1,050,000 elsewhere, with at least 10 full-time US jobs.
  • Switching inside the US is possible. An investor in lawful E-2 status may file Form I-485 (adjustment of status) together with the EB-5 petition when a visa would be immediately available; otherwise the green card is issued through a US consulate.
  • Children age out at 21. E-2 dependant status ends at 21; in a green-card case, the Child Status Protection Act may protect some children, but not all.
  • Plan the order early. Your existing business, your talent profile and your children's ages decide which bridge fits, and when to start.

Can an E-2 visa become a green card?

An E-2 visa cannot become a green card by itself, because the E-2 is a non-immigrant classification for people who intend to leave the United States when their status ends. The USCIS page on E-2 treaty investors describes a stay of up to two years at a time, extendable in increments of up to two years with no limit on the number of extensions, as long as the business continues to qualify. However many times you renew, the E-2 stays temporary. There is no point at which ten or twenty years of E-2 status turn into permanent residence.

A green card requires an immigrant category: a separate petition, with its own legal test, its own fees and, in most categories, an annual visa limit. The E-2 can be the platform from which you pursue that category, because you already live in the United States, run a business there and build a record there. What the E-2 cannot do is replace the immigrant petition.

Does applying for a green card put my E-2 at risk?

Applying for a green card does not, by itself, cost you your E-2. The E-2 is not dual intent, so you must still intend to depart when your E status ends. But the federal regulation 8 CFR 214.2(e)(5) states that an E application may not be denied solely on the basis of an approved labour certification or a filed or approved immigrant visa preference petition. In practice, this gives E-2 investors room to pursue a green card while they keep renewing and running their business.

Timing still matters. Renewals, travel abroad, consular interviews and the date you file for adjustment of status each interact with your intent and your status. This sequencing is exactly what your independent licensed US immigration attorney plans with you before the first immigrant petition is filed. For the basics of the E-2 itself, see our page on the E-2 treaty investor visa and the E-2 guide for Germans, Austrians and Swiss.

Which green card routes are open to an E-2 investor?

Six routes lead from E-2 to permanent residence. Which one fits depends on your capital, your professional record, your company structure and your family. The table compares them side by side; the sections below explain each one.

EB-5: the investment route to a green card

EB-5 is the only US green card based on investment, and it is the most direct bridge for an investor who already thinks in capital and business terms. The investment is USD 800,000 in a targeted employment area or an infrastructure project, or USD 1,050,000 elsewhere, and it must create at least 10 full-time jobs for qualifying US workers. One investment covers the investor, the spouse and unmarried children under 21. EB-5 is open to every nationality.

Unlike the E-2, EB-5 leads first to a two-year conditional green card. Form I-829 is filed in the 90 days before the second anniversary to remove the conditions, and USCIS then reviews whether the investment was sustained and the jobs were created. Your E-2 business and an EB-5 investment are legally separate: an E-2 company can only count for EB-5 if it meets the EB-5 rules on its own, which your attorney assesses case by case. Read our EB-5 programme page and our comparison EB-5 vs Grenada E-2 for the full picture.

EB-1A: the extraordinary ability green card

EB-1A is a self-petitioned green card for people who can show they are among the small percentage at the very top of their field. You need either a one-time major internationally recognised award, or evidence meeting at least three of ten regulatory criteria, followed by a final merits determination by USCIS. No job offer, no labour certification and no investment are required; money cannot replace acclaim. Some E-2 founders build exactly this record over years of running a successful US business. Premium processing is available: USCIS acts on the Form I-140 petition within 15 business days. See our EB-1A green card page.

EB-2 NIW: the national interest route

The EB-2 National Interest Waiver is for applicants with an advanced degree or exceptional ability whose proposed endeavour has substantial merit and national importance. Under the three-part test that USCIS applies, the job offer and labour certification can be waived, so you may file for yourself. Note that "exceptional ability" in EB-2 is a lower standard than the "extraordinary ability" required for EB-1A. For entrepreneurs, capital raised from third parties can be evidence that you are well positioned to advance your endeavour, but it is not a qualifying amount. With premium processing, USCIS acts on the petition within 45 business days. See our EB-2 NIW green card page.

EB-1C: through a multinational company structure

EB-1C is the green card for executives and managers of multinational companies, and it is relevant to E-2 investors who also own an operating company abroad. The US employer files the petition; no labour certification is required. The core rules: you worked abroad for at least one year in the three years before filing, or before your entry as a non-immigrant, in a managerial or executive capacity, for the same employer or a related company; the US company is that employer or its subsidiary or affiliate; and the US company has been doing business for at least one year. How an owner shows the employer and employee relationship is a point US counsel confirms case by case. Most owners reach EB-1C through the L-1A intracompany transfer visa, which, unlike the E-2, is dual intent.

Marriage to a US citizen

The spouse of a US citizen is an immediate relative under US immigration law. According to USCIS, immigrant visas for immediate relatives of US citizens are unlimited, so there is no waiting line for a visa number. The US citizen files Form I-130 for the spouse, and a spouse who was inspected and admitted, for example in E-2 status, and is physically present in the US may apply to adjust status with Form I-485 without leaving the country. This route is stated here for completeness: it applies only where the marriage exists in its own right, and it is never a planning tool.

Employer sponsorship

A US employer can sponsor a green card through the employment-based categories that need a job offer and a labour certification (PERM). For the E-2 investor personally this route is rarely practical, because the principal may work only for the E-2 enterprise. It is often more relevant for the E-2 spouse: spouses in valid E-2 status are employment authorised incident to status and may work for any employer. The spouse may still request a work permit, but the annotated I-94 is already accepted as evidence. If a US employer sponsors the spouse, the investor and the children can follow as derivatives.

Can I switch from E-2 to EB-5 inside the United States?

Yes, an E-2 investor in lawful status can usually complete the EB-5 green card inside the United States through adjustment of status. There are two ways to the green card once you have filed your EB-5 petition, Form I-526E for a regional-centre investment or Form I-526 for a standalone investment:

  • Adjustment of status in the US. If approval of the petition would make a visa immediately available, Form I-485 may be filed together with the EB-5 petition (concurrent filing under INA 245(n)). In October 2026 USCIS directs employment-based filers to the Visa Bulletin "Dates for Filing" chart, according to the USCIS EB-5 questions and answers. While the I-485 is pending, you and your family may apply for an employment authorisation document and for advance parole; work authorisation starts only once the EAD is approved.
  • Consular processing abroad. If you prefer, or if adjustment is not available, the green card is issued through an immigrant visa interview at a US embassy or consulate.

Government fees as of 12 October 2026, from the USCIS fee schedule (G-1055): Form I-526 or I-526E USD 3,675, plus a USD 1,000 integrity fee on an initial I-526E; Form I-485 USD 1,440 on paper or USD 1,390 online. On the consular route, the immigrant visa application fee is USD 345 and the USCIS Immigrant Fee is USD 235 per person. A new EB-5 fee rule takes effect on 30 November 2026: from that date Form I-526 costs USD 7,615, Form I-526E costs USD 7,850 plus a USD 1,100 integrity fee, and Form I-829 costs USD 5,000, up from USD 3,750. The investment amounts themselves are adjusted for inflation for petitions filed from 1 January 2027; the new amounts have not yet been published.

Since 30 March 2026, USCIS generally handles Forms I-526 and I-526E in filing order. Whether a visa is available for you depends on your category and country of birth, which the State Department publishes in the monthly Visa Bulletin. We do not quote processing times or Visa Bulletin dates in this article: your attorney reads the current chart on the day of filing.

What happens to my children when they turn 21?

On the E-2, unmarried children under 21 can live and study in the United States as dependants, but they may not work. At 21 they lose E-2 dependant status and need their own status, such as a student visa, or must leave the country. This is the point at which many E-2 families start thinking seriously about a green card.

In a green-card case, the Child Status Protection Act can help. According to USCIS, the CSPA does not change who counts as a child; it calculates an age for immigration purposes. For a derivative child in an employment-based case, the formula is the age at the time a visa becomes available minus the time the petition was pending. The child must remain unmarried and must seek to acquire permanent residence within one year of the visa becoming available, for example by filing Form I-485. The CSPA protects some children, not all. If your eldest child is a teenager, the date you file the immigrant petition can decide whether they come with you as a derivative or need a route of their own.

What should Germans, Austrians and Swiss consider?

Germany, Austria and Switzerland all have E-2 treaties with the United States, so DACH investors often start on the E-2 and look at the green card later. Many search for "E2 Visum Greencard" expecting a conversion; the honest answer is the same as above: no conversion, but six bridges. For the wider picture of US routes for German speakers, see our guide Auswandern USA: visa routes and the USA immigration hub.

A green card is also the first step towards US citizenship: naturalisation is possible after five years of permanent residence, and EB-5 conditional residence counts towards those five years. For the spouse of a US citizen, USCIS lists three years as a permanent resident while living in marital union with the US citizen spouse, among other requirements, on its page for spouses of US citizens. If you plan that far ahead, your home country's nationality law matters:

  • Germany: under German law, a German who acquires a foreign nationality no longer loses German citizenship. The former loss rule, § 25 of the Nationality Act (StAG), has been repealed, and the Federal Office of Administration (BVA) confirms the retention permit procedure ended on 27 June 2024. Losses under the old rules before that date remain valid.
  • Austria: under Austrian law, a person who acquires a foreign nationality on their own application loses Austrian citizenship unless retention was approved beforehand (Citizenship Act 1985, section 27). Apply for retention before any US naturalisation, never after.
  • Switzerland: under Swiss law, dual nationality has been recognised without restriction since 1 January 1992, and Swiss citizens who acquire another nationality abroad keep their Swiss citizenship unless the other country requires them to give it up, according to the State Secretariat for Migration (SEM).

Other nationalities follow their own law, and some countries remove the original nationality automatically on naturalisation abroad. Check your own country's rules before you file. Note also that a green card makes you a US tax resident under the IRS green card test; plan your tax position with qualified independent tax counsel in both countries before the green card is issued. Our article how Germans get US citizenship covers naturalisation in detail.

Which bridge fits which E-2 investor?

  • You have the capital and want certainty of category: EB-5 is the route built for investors, and it covers your spouse and unmarried children under 21 with one investment.
  • Your business record speaks for itself: EB-1A or EB-2 NIW, with no investment and the option to file for yourself.
  • You own an operating company in Germany, Austria or Switzerland: EB-1C, usually through the L-1A, keeps your home company at the centre of the plan.
  • Your spouse has a strong US career: employer sponsorship of the spouse may carry the whole family.
  • You are still deciding: the E-2 lets you run a US business now; for franchise investors, our guide to buying a US franchise for the E-2 and the E-2 franchise route explain the starting point. Compare other residence options on our golden visa overview.

In summary

The E-2 is an excellent way to live in the United States and run your own business, but it is not a green card and never becomes one by itself. Permanent residence comes through a separate bridge: EB-5 if you invest, EB-1A or EB-2 NIW if your record qualifies, EB-1C if you own a multinational structure, or a family or employer route where one genuinely exists. Choose the bridge early, watch your children's ages, and check your home country's nationality rules before you plan citizenship. Mirabello Consultancy helps German, Austrian and Swiss investors map that path with Swiss precision and absolute discretion.

Frequently asked questions

Frequently asked questions

Can an E-2 visa be converted into a green card?

No. The E-2 is a temporary, non-immigrant visa without dual intent and does not convert into a green card. You need a separate immigrant petition, such as EB-5, EB-1A, EB-2 NIW, EB-1C, a family petition or employer sponsorship.

Will filing for a green card get my E-2 renewal refused?

Not by itself. Under 8 CFR 214.2(e)(5), an E application may not be denied solely because an immigrant petition was filed or approved. You must still intend to depart when E status ends, so your attorney plans the timing of renewals, travel and filings.

Can I switch from E-2 to EB-5 without leaving the US?

Usually yes. If a visa would be immediately available, you may file Form I-485 together with your EB-5 petition and adjust status inside the US. While it is pending you may apply for work and travel documents. Otherwise the green card is issued through a US consulate.

How much does EB-5 cost for an E-2 investor?

The investment is USD 800,000 in a targeted employment area or infrastructure project, or USD 1,050,000 elsewhere, creating at least 10 full-time US jobs. As of 12 October 2026 the I-526 or I-526E fee is USD 3,675; higher fees apply from 30 November 2026.

Does my E-2 business count as an EB-5 investment?

Only if it meets the EB-5 rules on its own, including the investment amount and the creation of at least 10 full-time jobs for qualifying US workers. The two classifications are legally separate, and your attorney assesses this case by case.

What happens to my E-2 children at 21?

They lose E-2 dependant status and need their own status, such as a student visa, or must leave. In a green-card case, the Child Status Protection Act may protect some children by calculating an adjusted age, but it does not protect every child.

Is EB-1A or EB-2 NIW better for an E-2 founder?

EB-1A requires extraordinary ability with sustained acclaim; EB-2 NIW requires an advanced degree or exceptional ability plus an endeavour of national importance. EB-2 NIW is the lower standard. Neither needs an investment, and both can be self-petitioned.

Can my E-2 company sponsor me for EB-1C?

Possibly, if the US company is the same employer, or a subsidiary or affiliate, of a company abroad where you worked as an executive or manager for at least one year in the relevant three-year period, and the US company has done business for at least one year. Owner cases are confirmed by counsel.

Does my spouse need a work permit on the E-2?

No. Spouses in valid E-2 status are employment authorised incident to status, and the annotated I-94 is accepted as evidence. The spouse may still request a work permit. This also makes employer sponsorship of the spouse a possible green-card route for the family.

Do Germans lose their citizenship if they become US citizens later?

Under German law, no: since 27 June 2024 Germans keep German citizenship when acquiring a foreign nationality. Under Austrian law, citizenship is lost unless retention was approved beforehand. Swiss law allows dual nationality. Other countries follow their own rules.
